 反年改聲請釋憲 大法官決議不受理


軍公教年改7月1日上路，不過有不少民眾提出訴願，甚至有公教人員質疑修正後的「公務人員退休資遣撫卹法」及「公立學校教職員退休資遣撫卹條例」違憲，陸續向司法院大法官聲請釋憲。

不過司法院大法官會議認定全案未經訴訟程序就聲請釋憲，不符「司法院大法官審理案件法」之規定，今天(13日)決議不予受理。

大法官會議指出，「須窮盡法律救濟途徑」此一規定，已在2003年2月21日大法官第1211次會議中設下「雖未盡審級救濟程序，如事實已臻明確而無爭議餘地，且在憲法上具有原則之重要性，經大法官議決受理者，不在此限」之例外規定，但此次的4件釋憲聲請案，完全未經訴訟程序就聲請釋憲，仍與相關決議意旨不符，且聲請人也未具體指出有何違憲之處，因此決議不予受理。
